Hieu “Tom” Truong, 60, of Houston, was the pharmacist-in-charge at S&S Pharmacy in Houston, TX. In 2019,  Dr. Truong was charged with one count of conspiracy to unlawfully distribute and dispense, and possess with intent to distribute, controlled substances pursuant to 21 U.S.C. § 846, and three counts of unlawfully distributing and dispensing, and possessing with intent to distribute, controlled substances; and aiding and abetting pursuant to 21 U.S.C. § 841(a)(1) & 18 U.S.C. § 2. On May 27, 2022, Dr. Truong was convicted of three counts for unlawfully distributing controlled substances. But a month later, the Supreme Court decision for Ruan vs the United States was released, which stated that the defendant must know they were acting in an unauthorized manner. So Dr. Truong filed for a retrial, and in May 2024, a retrial was granted, with the retrial to be in June, 2024. The judge’s decision on that can be found HERE.

Besides the fact that he was an independent minority pharmacist, he was targeted for filling 8,000 controlled substance prescriptions and dispensing around 750,000 doses of controlled substances over 18 months. But if the prescription directions were correct for the prescription, and an appropriate number of pills per month were covered, that number of pills is completely legitimate.  But of course, numbers thrown out like that by the press will affect the mind of jurors.

Then the prosecution charged him with doing business in cash.  When is accepting cash a crime?  Then, to top it off, there were actual prescriptions!  But the government claimed they were forged or stolen.  Now how is a pharmacist supposed to know that?  My guess is that the government knew these prescriptions were being forged long before they indicted Dr. Truong, but they kept silent.  What they should have done was inform him of their illegality so that he could then refuse to fill them.  But no, they would rather close down an independent pharmacy and put a minority pharmacist in prison.  Welcome to America!

You see, all of these “REAL” criminals get money from Dr. Truong’s assets.

In the June, 2024 trial, Dr. Truong was convicted of counts three and four of unlawfully distributing and dispensing controlled substances. The jury found him not guilty of the other charges of unlawful distribution. Dr. Truong’s attorney, Beau Brindley, made a statement about this incongruency:

“In finding Mr. Truong not guilty on count two, the jury rejected the government’s theory that Mr. Truong was a knowing participant in the fake prescription scheme,” Brindley said. “He was victimized by people who are now getting cooperation benefits from the government. We believe the convictions on counts three and four result from jury instructions that we have vehemently challenged. We will continue that fight until we see Mr. Truong fully exonerated.”

The people “getting cooperation benefits from the government” that he mentioned are the seven other people charged who have pleaded guilty to unlawfully distributing controlled substances who were those who received the drugs with possibly illegal prescriptions. So they should be held responsible for breaking the law, but the pharmacist is innocent.

How to End These Attacks

If you want these attacks on good, compassionate medical professionals to end, you must help get the Controlled Substance Act repealed.  Understand this:

NO DRUG CAUSES ADDICTION!!
