Pawankumar Jain, M.D, 64,—another minority casualty in, what I term, an establishment ethnic cleansing of the medical profession—was a neurologist in pain management in Las Cruces, New Mexico. Having spent 2 years in jail as an innocent man, he finally pleaded guilty in Feb. 2016 to one count unlawfully dispensing drugs and one count health care fraud. What happened to “innocent until proven guilty”? This is one of the ways that the government is putting innocent doctors in prison—preventing their ability to defend themselves. Lawyers don’t do much for people sitting in jail cells. Under the terms of his plea agreement, Dr. Jain will be sentenced to a prison term within the range of 42 to 108 months. He continues to be held locally after his guilty plea until his sentencing, but that doesn’t appear to have happened yet, 18 months after his plea—out-of-sight, out-of-mind.
Through 2 series of indictments, Dr. Jain was finally charged with 79 “unlawful” dispensing charges and 59 healthcare fraud charges based on the “unlawful” dispensing between April 2009 and June 2010, including allegations that his conduct resulted in the death of four patients. His license was suspended in June, 2012, and then revoked in Dec, 2012.
According to his plea, Dr. Jain acknowledged that in his treatment of one patient he conducted “cursory exams and did not document a therapeutic benefit from the narcotics he was prescribing.” Well, in a real court of law—that follows the laws actually written—that statement is proof of actual innocence. According to the Controlled Substance Act, a doctor is exempt from charges for evaluating a patient in his office. The fact that an exam took place is proof that there was an evaluation in the doctor’s office.
The charge of health care fraud is based on this erroneous charge that the doctor’s exam of the patient was “cursory” and he billed to Medicare. Doctors take note: the government is out to reclaim all moneys paid to you by government insurance and pad the prison economy with you in a prison cell. Every doctor in this country needs to stop taking government insurance.
In order to achieve recognition from their respective agencies, U.S. Attorney Damon P. Martinez, DEA Agent Joseph M. Arabit and Will Glaspy, FBI Agent Carol K.O. Lee and Terry Wade made the usual outlandish propagandizing statements to the press, and admitted their collusion with the New Mexico Medical Board in attacking Dr. Jain.
Addendum
Dr. Jain was finally sentenced to 9 years in prison. He did his time and was released from prison in 2021. Please, Dr. Jain, get on board the work to stop this from happening to other doctors and to get all of us exonerated.
Anyone in communication with him, please tell him to work on forgiveness and when he is ready, join us in the effort to restore humanity to the nation.
Addendum from the author:
I have failed in my mission to end these attacks on doctors and pain patients. Through John Bevere’s book The Bait of Satan, I have figured out why—my lack of forgiveness to those who attacked me. As in Mark 11: 24-26:
“Therefore I say to you, whatever things you ask when you pray, believe that you receive them, and you will have them. And whenever you stand praying, if you have anything against anyone, forgive him, that your Father in heaven may also forgive you your trespasses. But if you do not forgive, neither will your Father in heaven forgive your trespasses.”
And when you do not do the will of the Father, you are estranged from him and he will ignore you. So we all must forgive the agents who attacked us in order for things to be made right through any of our works.
Jesus said
“Greater love has no one than this, than to lay down one’s life for his friends.”
But we cannot lay down our lives for God unless we know Him well enough to trust Him. We must have the assurance that He would never do anything to harm us. He always looks out for what He knows is in our best interest. As a nation, those of us suffering from these attacks must understand that we are serving as God’s messengers of love. We must forgive those who persecute us and love them instead, following God’s will for us. Then and only then will we see fruits from our labor.
So I hope that everyone who has suffered from what happened to the doctor can trust the Lord, forgive those who have hurt you, and help bring this country back to the God-fearing country that our forefathers founded. Then, and only then, can you be a part of the effort to stop these attacks. I look forward to that day.
To end these attacks, restore pain management, and provide compensation to all the families that have been destroyed by government overreach, we must get the Controlled Substance Act repealed. Join Doctorsofcourage to get that done. Learn what we teach and spread the word. NO DRUG CAUSES ADDICTION!! Let’s end the War on Drugs, Doctors and Pain Patients, end the black market, solve the southern border crisis, and restore proper pain management. It CAN be done!

A victim of prosecutorial misconduct and outright law-breaking of the government agencies DEA, DHHS, and DOJ, she hopes to be a part of exonerating all doctors illegally attacked through the Controlled Substance Act. 9 years. Would someone please post the name of his lawyer? https://www.thehansindia.com/news/international/indian-orgin-doctor-commits-healthcare-fraud-in-us-gets-9-year-imprisonment-528574
Dr Pawan Jain remains in the Dona Ana Detention center, a frequently sued hellhole that lacks even rudimentary medical care. His sentencing “hearing” after 6 years resulted in the “Judge” still deliberating for 4 or so more months while Dr. Jain is going blind and has out of control diabetes. He has has cataract surgery but got no glasses after and still needs surgery on the other eye. Therefore he is legally blind thanks to the DEA, DADC, and the County Courts.
He has had all of his assets seized through civil forfeiture, the DEA’s favorite tool to assure no one has the ability to defend themselves. His stay in the DADC has cost the local taxpayers over a Million dollars when he is not a DANGER TO ANYONE. He is just another example for the DEA to hold over other physicians to assure that no one can prescribe pain medication without fear of losing everything they have plus their ability to practice.
BTW, one “death” Dr. Jain was accused of was a psychiatric patient (under another Drs. Care) who HUNG himself but had a prescription rx on board. Yup, prescription overdose by Dr. Jain. MBA;MHCA, RN
His sentencing hearing is scheduled for Tuesday, November 20, 2018 in Las Cruces, NM. He is currently detained. Check https://www.donaanacounty.org/inmates/viewprofile/1400003776 for his mugshot.
Try to double check your resources and ensure you’re using the correct picture within your articles.
That is not the picture of Pawan Kumar Jain.
I do try to get the correct picture. But I have to rely on other articles with the picture. Or I use LinkedIn if the doctor has a presence there, or Facebook. Before I print a picture, it has come from one of those three sources. If this is not his picture, could someone share a correct one with proof of identity? Thanks.
That picture is him.
Dr. Jain was one of THE BEST Neurologists in SW New Mexico!! He was my doc for years. Trusted his diagnosis of test results more than the hospital personnel reading & writing reports. What happened to Dr Jain was a plain & simple case of DEA looking for scapegoats. I’m looking forward to him getting back in practice! I’ll be a patient STILL!
I agree with this. Dr Jain saved me from my doctors who were busy prescribing pain medications for headaches when all they needed to check was my neck. I had a rollover accident and injured my neck but no one ever checked my neck. Dr Jain sent me for an MRI and found two fractures with a herniated disc which all of these were causing the headaches I was getting. Thank you Dr Jain, he saved my life.
Yes, it is his picture. He was our family’s neurologist.
Dr Jain is currently in the Dona And county detention center in Las Cruces NM
Do you know what he was sentenced to. I know he was sentenced a little while ago
9 yrs prison, 3 yrs supervision. Bullshit what they did to him.
