On July 11, 2022, two weeks after the 9-0 decision by the Supreme Court for Drs. Ruan and Kahn, 62 y.o. osteopathic physician David Jankowski was convicted on thirty charges of “unlawful” distribution of Schedule II, III and IV controlled substances and health care fraud.
The trial began on May 10, 2022, 6 weeks before the June 27 Supreme Court announcement, so the prosecution had lots of time to fill the jurors’ heads with propaganda against opioids. The propaganda is the primary reason doctors get convicted.
Dr. Jankowski, an anesthesiologist and pain management specialist, was recognized as a 2017 Top Doctor in Dearborn Heights, Michigan. Dr. Jankowski worked out of several clinics in Michigan. The charges against him were for writing “medically unnecessary” prescriptions for controlled substances. This is the standard charge that has convicted doctors for the past 25 years. But the Supreme Court decision now states that this isn’t enough to convict. So how did it happen?
Well, according to the press reports, the prosecution threw out numbers of pills prescribed, using the Controlled Substance Act phrase they have criminalized over the years, issued “outside the course of professional medical practice and for no legitimate medical purpose”, claiming he did that in exchange for money. Let’s see now. Every doctor in the country gets paid for treating patients. So how is being compensated for his treatment a crime? Does the government expect doctors to treat people for free? Actually, folks, that is their plan. You see, they charge doctors with fraud, collecting 5 times more than the doctor received, and so doctors actually treat government-insured and pay the government for the privilege! What other profession has to do that? But doctors just stand by and let their colleagues get attacked! “It’s not going to happen to me! I’m doing everything right!” Until it does happen to them, and then they come to us with a “Help me” plea. They should be on board before the attack comes! And now that the door is partially closed to attack doctors for prescribing, they will be focusing more on fraud, and every doctor is liable. The DOJ has already moved to this avenue of attacking doctors now that the Supreme Court has made attacking the prescribing of opioids a more difficult task. USA Ison warned that investigators are “aggressively investigating health care fraud and detecting abuses by doctors”
Here are some of the FACTS of the case.
Dr. Jankowski was charged and convicted with
- Giving a prescription to a patient being discharged using the CDC guidelines, although by standard of care, the doctor is responsible for 30 days of care post-discharge.
- Charged for doing a urine drug screen on an government informant that was discharged because his UA showed cocaine.
- Charged for giving a non-narcotic injection of Toradol to a patient
- Charged for “unnecessary” pain meds when their expert never reviewed the chart.
- Charged with doing an osteopathic manipulation on a patient that the government expert with no training said was unnecessary.
He did psych exams on patients at their initial visit. The government criticized him for doing them, and then later said he didn’t do enough psych evaluation.
As for the numbers of pills prescribed? It is fact that his midlevel practitioners wrote many of the scripts he was charged with. The Pharmacist filled the scripts under his DEA number, so that warped the numbers submitted by MAPS, the Michigan Automated Prescription System, that tracks prescriptions.
One interesting fact released by the press is that, since 2017, 65 Southeast Michigan doctors have been charged or convicted with running “pill mill” operations. The real reason for these attacks is job security for these defunct government agencies and confiscation of doctors’ assets. Just one more piece of evidence that America has turned its back on the God-given justice put into law by our founding forefathers.
Following his conviction, US Attorney Ison, FBI Agent James A. Tarasa, and HHS agent Mario M. Pinto, bragged about their work destroying doctors doing their job. Their comments of putting patients at risk and stemming the tide of opioid addiction is actually a statement against what they do, because it is the attacks on legitimate doctors like Dr. Jankowski that force patients to the streets for self-treatment where they then have a higher potential for overdose. The increased stress in patients not getting pain relief also increases their toxicity which can cause more to actually cross into the realm of addiction. So the government, not the treating physician, is the cause of increased addiction today.
The press is just as guilty at causing Dr. Jankowski’s conviction by spreading government propaganda. Every article about the trial uses the phrase “highly addictive” with respect to opioids. This is false propaganda. No drug causes addiction. This is proven through the science of homeopathy, a science based on true experimentation, not just conventional modern-day trials that only prove what the experimenter sets out to prove.
Hopefully, with the result of the Ruan/Kahn decision, Dr. Jankowski can get the conviction thrown out. His sentencing is scheduled for November.

I know Dr David Jankowski both personally and professionally.
He is a good doctor and a good man.
This upsets me very much. I have worked with Dr.Jankowski for three years and have witnessed him care for his patients personally.
Anesthesiologists and pain doctors are now the lowest hanging fruits for the DEA and the prosecutors to go after. Shame on them. THE REAL PROBLEM IS MEXICO & CHINA(FENTANYL).
They are destroying so many doctors lives.
First the CDC,AMA and medical societies told the doctors to address and treat people’s pain and now they are prosecuting the doctors for helping the patients. SHAME ON YOU DEA/FEDS.
Then you need to join us as a professional and support our work. The CSA must be repealed. It is a 100 year old failure and doesn’t address the cause of addiction. It is a source of free slave labor in the prison system and disenfranchisement of minorities. With your last hame, you could be next. It’s too late to get on board after you’ve been attacked.
Honest to God this makes my blood boil.
This makes me livid. Dr. Jankowski is an amazing physician who took the time to help me with my spinal cord injury. I was in a motorcycle accident in 2006 and have a brachial plexus injury. This causes severe pain that no other physician was able to help me with. I met Dr. Jankowski through my wife and we became friends. He has a heart of gold, and he never gave up on trying to fix my condition. He spent countless hours of his own time researching different treatments and ways to help me reduce my pain. There are not a lot of doctors or research out there for my condition. This is a shame what is happening to a such a good person who’s profession was to help people in pain. The way they have wrongfully framed Dr. Jankowski makes me lose faith in our judicial system.
The entire judicial system is corrupt. They attack anyone they want, and use any method, even illegal, to convict. The rule is now, convict with whatever will work. Forced perjury, lies, and actual law-breaking is the rule. We must remove actual immunity from government agents who break the law.
Unfortunate; a kind caring physician. He ensured that my treatment was commensurate with constant pain after an automobile accident. He had an interest in treating my case with minimal drug, The man was a gem. I pray that he overcomes this travesty as he provided this patient

This story sickens my soul. That a physician takes an oath to do no harm and treat chronic pain patients in the standard of care. Only to be judged by a jury and the Federal government that lacks any medical knowledge. Yet, they have the ability to pass judgement and hopefully not a sentence.
I have been a victim of government pointing in patient care for pain management. I know all to well the disgust Dr. Jankowski is going through what his patients feel and his families sorrow.
This chronic victimization by the FBI on pain doctors needs to be stopped immediately. Stop utilizing doctors as your escape goats for not having control over our narcotic and street drug crisis.
The FBI has the nerve to watch narcotics and illegal drugs enter our society for months to years. All of this just to pad a case for themselves. Who here is the real criminals here?

The main witness is a convicted criminal who robbed David’s clinic. He was given a sentence reduction to testify. The FBI agent was a drug user himself. Clearly this jury didn’t understand the concept of “reasonable doubt” and the ” witch hunt” continues by the feds. I used to have faith in our judicial system – no more. This is a very sad story and destroying many lives including the good doctor, his family and all of the legitimate patients who relied on him for help.

Hello Linda, to be more accurate, the” big witness” in this case, that caused the Grand Jury to indict Dr Jankowski, robbed a pharmacy, because clearly he couldn’t get as many drugs from being Dr Jankowski’s patient as he needed to sell on the street. He was convicted to 14 years in prison, but managed to cut it in half when he testified against Dr Jankowski, and his own best friend for a marijuana business. He made up some story about how he was introduced to Dr Jankowski by his friends sister, who actually testified that he was lying and she didn’t know the doctor at that time.
The undercover agent, which is not an FBI agent, simply a hired informant, was discharged from Dr Jankowski’s practice on his 10th visit for his second offense of cocaine in the urine. I am not sure how public we want to take this, as I am sure David is hoping for an appeal! I greatly appreciate your courage in speaking out against this criminal NON-justice system!
Forced or bought perjury against doctors is general protocol for the DOJ. It is simply evidence of how this country has left God for their own idols of prestige and money. If we don’t clear this immorality from our country we are doomed as a nation.
