Gilbert Ross Ghearing, MD, 65, a family practitioner who treated pain in Celina, Tennessee, was charged May 17, 2019 with violating the Controlled Substances Act by prescribing controlled drugs “outside the usual course of practice and not for a legitimate medical purpose”. This is the standard restructuring of the CSA by the DOJ outside of its intent, in order to attack compassionate physicians and confiscate their assets for the government agency’s own financial benefit.
The government actually states in their press release that the charges stem from the doctor’s prescriptions to patients. That is automatic exemption by the Controlled Substance Act, as per multiple Supreme Court decisions that state that as long as the doctor is not selling scripts to addicts on the street corner, but to legitimate patients, he/she is exempt.
The federal government again commits unconstitutional government overreach into a medical office by acting as a medical reviewer over the decision making of the doctor. Per §802(56)(c), only the doctor can determine legitimate medical practice. But the government uses easy “identifiers” to target specific legitimate medical practices, such as the prescription of combinations of benzodiazepines and opiates. This has been legitimate medical practice for 50+ years, only recently becoming an easy target for the government because of the numbers of pain patients that are on this combination. As a rule, it is safe when taken as prescribed. And those that have overdosed are primarily patients that have been thrown to the street by the government’s closing down medical practices. As more pain patients develop anxiety over whether their pain will be treated adequately, this is an easy way to target the compassionate physicians.
The government also uses lies in their charges. In this case they state that patients had a past medical history of abuse including multiple instances of overdoses. The DEA agents are trained to lie and state that the doctor being targeted “knows” his patients are abusing. Or could it just be from the DEA’s basic premise that anyone on an opioid is an addict? That’s probably the correct scenario.
The government then cinches the case by making it look like Dr. Ghearing was running away from something when they state that “while under investigation for federal offenses, he booked a flight to depart on May 19, 2019, with a final destination to the Marshall Islands.” But doctors aren’t informed that they are “under investigation”. Not until the raid do they have any suspicion that the government has them in its sights. That’s because doctors prescribe according to the law and are generally completely naïve to what the government is doing, until it happens to them.
Dr. Ghearing announced earlier this month that he was retiring from practice for health reasons. Any other profession can retire and move to a tropical island without being charged with a crime. Why is this happening to legitimate doctors? MONEY!!
Ghearing’s attorney complained that US Attorney Cochran had made inflammatory statements to the press that make it impossible for Ghearing, a 30-year military veteran with no criminal history, and other medical professionals, to get a fair trial.
But the media helps the government by printing the government’s lies and innuendos so that the doctor is forced, usually, to accept a plea even though they’ve done nothing wrong. And they print the standard phrase used by every US Attorney now to make a doctor look like he/she violated the Controlled Substance Act, even though it’s a made-up charge—the “drug dealer in a white coat” line.
The Government Knows How to Brainwash the People 1. Say it often enough and people will believe it. 2. Use simple repeated words (pill mill, pill mill, pill mill)
As Hitler said, “Make the lie big, make it simple, keep saying it, and eventually they will believe it.”
So now Dr. Ghearing sits in a jail cell wondering what the heck is going on. If he caves in to the government bullying, he could spend the rest of his natural life in prison. And the government agencies involved in his “investigation” reap the benefits of the forfeitures and fines. These money-grubbing agencies involved in this lawlessness are the DEA, DHHS-OIG; the Tennessee Bureau of Investigation, Assistant U.S. Attorney Sarah Bogni, U.S. Attorney Don Cochran, and U.S. Magistrate Judge Alistair Newbern.
Word to the wise to other innocent physicians:
If you are going to leave the country to spend your retirement in paradise, don’t buy your tickets in advance. Just hop a plane.

Dr. Ghearing was convicted by jury on March 29, 2023, in spite of the Ruan/Kahn SCOTUS decision.

Dr Ghearing passed away January 27, 2024 at the age of 69. The cause of death has not been determined. I do not see where he had been sentenced.

Hard to believe that he did what he’s accused of! He’s my family’s pcp in the late 90’s and early 2000’s and he truly cared about his patients! If he didn’t know what was going on he admitted it & sent me & my parents elsewhere for testing and to specialists! I truly feel like my dad might still be alive right now if Doc had stayed in Marion County instead of moving!
I remember him going into my mom’s classroom reading to her students 1 day when I had taken her lunch a day after having a tooth extracted in which my dentist prescribed pain medicine that come to find out I was allergic to & telling me to trash immediately when we got home! If it hadn’t been for him being around seeing me have an allergic reaction gosh no telling what might have happened to me. As soon as he saw me itching unreal he’s like get Benadryl immediately and he stayed in my mom’s room until he saw I was ok. If Doc was $$$$ hungry he wouldn’t have been at a school reading to kids he’d been in his office that day.

He is innocent. I wasn’t at the trial, but the problem with trials these days is that the prosecution can commit crimes to get people to commit perjury against innocent defendants. There is no repercussion for them when they do. We have to take away immunity from government agents that commit crimes. Nowadays it’s a no-holds-barred system. Do whatever they need to do to convict their target. It’s all about jobs and money–not the doctor, but the Justice Department. Then they planted the propaganda into the juror’s heads that opioids cause addiction. We have to get people to understand that no drug causes addiction. End the war on drugs, and get the controlled substance act repealed.
Dr. Ghearing is an upstanding citizen. I’m not even sure how many times he left his practice to serve his country in Iraq and Afghanistan. He was a lifesaver back in the 90s when I was caring for my elderly grandparents. He reduced their prescriptions, which in the past had been added by physicians with no concern how they interacted with each other. At the same time, he treated me for severe spine issues. I never asked for pain pills, and he never offered a prescription. I’m sure if he was a pill pusher my condition would have rated pain pills. I’ve never heard such outlandish claims about Dr. Ghearing as what the DEA is claiming, but then aren’t they the ones who “manage” the importation of illegal drugs into this country?
Dr. Ghearing saved my life. He has been my doctor for I er 20 years and has seen my children as well. I love this man he is an Amazing wonderful doctor and friend. This is a tragic situation and I will stand by him and dolly in support anyway I can. There is absolutely no better physician in the US.
My husband had dr. Ghearing as a physician and he was very easy going and very nice. The only problem we had was that his nurses would never give him the messages we left. Finally my husband caught him early one morning answering the phone and told him that those nurses of his was going to get him into trouble one day by not giving him the messages. He did not take my husband serious and pretty much after that we had to get a new doctor because he sided with his nurses who never gave him messages. Maybe the nurses did same thing to him with the mother of person who Over dosed and he never got the messages. We warned him of his nurses getting him into trouble before this happened with him. I am sorry to hear this and I hope and pray that he will not be convicted. He is not the type of person to give people drugs that they would overdose on. I don’t believe for a moment that he is guilty. He is sweet, loving and very caring. I am praying for him and his family!!!!
Dr Ghearing was my handicapped sister in-laws dr, I took her to a couple appt, he is the most caring dr that I’ve met. My sister in law has a tendency to talk, a lot😊 dr ghearing patiently listened, he answered all of her questions until I said ok next time, dr ghearing said it’s ok let her finish, and he listened til she was done. His office didn’t have a bunch of people booked at the same time because they knew he is a dr that listens. It’s really a shame what’s going on with this dr, he is the kind of dr everyone wishes for
It infuriates me that innocent Drs are being charged just for treating us the way we deserve to be treated it angers me when ppl call Drs drug dealers in white coats the TRUE drug dealers is the government they have set up clinics where addicts can “safely”shoot up heroin how the hell can they justify this they cater to addicts while torturing those of us that are sick they are greedy as hell did u kno the CDC was broke when all this started now they have illegally seized 3.2 billion in assets they treat addicts like innocent victims while abusing and torturing those of us who are sick we didn’t choose to be sick addicts made the decision to b addicts they set up these clinics so addicts can keep being addicts theres more money to b made in treating addicts this has to stop we will keep fighting for our rights to b treated with the respect and dignity we deserve someday karma will bite them in the ass cant wait for that day to come

Dr. Ghearing was the best doctor I/we have EVER had. He delivered one of my children and was deployed on the baby we lost. He was a conservative doctor on medicine and procedures, and wouldn’t even induce a baby until it was at least 40 weeks. This witch hunt on good doctors makes me livid. I tried to reach out to him last week about a medical issue, and his wife told me he had passed away. This news has broke my heart and made me cry. Dr. G was awesome and I have truly missed him not being in my town. Now I can never talk to him again. Prayers for Dolly and all of their children.
If it wasn’t for Dr Gearing I wouldn’t b here he saved my life when I got septic after miscarrying set of twin boys at seven months pregnant. He tried everything other than giving me pain meds there’s not another one like him when he found out that the babies had to be removed the doctor even gave me gas money out of his own pocket so I could make it to the hospital in livingstone I just want to give Dr Gearing a big thank you and your my hero thank you for not giving up on me.

I had Dr. Ghearing in fayetteville. He is awesome. I hated it when he left to go back to the military. Now I’m reading all these awful things about him. And I dont like it. He is the best doctor I have ever had. And NOTHING “they” say will change that.
You need to join the fight so that he doesn’t go to prison and other doctors aren’t attacked as well. Just go to the membership levels and pick the one that fits. It is only through getting the work done that we will stop these attacks on good, compassionate physicians.
