Dr. Deshmukh was indicted Feb 18. He was charged with:
- Manslaughter in the Second Degree related to the overdose death of a patient.
- Two counts of Reckless Endangerment in the First Degree.
- Six counts of Criminal Sale of a Prescription for a Controlled Substance for over prescribing high doses of opioid.
- Health Care Fraud in the Fourth Degree for causing Medicare to pay for the medically unnecessary prescriptions that ultimately contributed to his patient’s death.
Typical media spewing opiaphobia from the mouths of criminal state attorneys in it for the money:
“Doctors have an obligation to help their patients heal, not drive them deeper into the depths of addiction,” said New York Attorney General Letitia James.
It’s amazing, but not unexpected, for the state and US Attorneys to be able to make a less-than-20-word statement contaminating the jury pool’s mind against a doctor. “Addiction” sticks in the mind of the general population, and the doctor is doomed.
Another general term thrown out there by government officials is “Without any legitimate medical purpose” and “dangerous combinations of opioid pain killers and other controlled substances.” This was referring to the combination protocol of an opioid, alprazolam (Xanax), and carisoprodol (Soma), named in government propaganda, as the “Holy Trinity”. Even though this combination of drugs has been used over the last 20 years safely and effectively, the government now imprisons doctors through their propaganda against the combination.
The charge for the overdose involved the government determining
- The patient had “signs of addiction”.
- The amounts prescribed were over the CDC guidelines.
- The amounts prescribed were appropriate only for end-of-life patients.
None of these reasons are justifiable. The government prosecutors are playing doctor and should be charged with practicing medicine without a license.
Showing the collusion between Boards of Medicine and government Justice Department targeting of minority, independent physicians, in 2019 the New York State Medical Board investigated Dr. Deshmukh’s treatment of this same patient and another, and left a paper trail for the Attorney General to use. Standard MO.
Attorney General James has also been actively involved in charging pharmaceutical companies, and confiscating millions of dollars through agreements with these companies in lieu of court. The pharmaceutical companies cave instead of standing up and fighting this government overreach. Interesting that the income from these attacks has provided more funding for the state than what they get from grants to perform their attacks. Follow the money.
Dr. Deshmukh had been treating the patient that died for years. The government called the patient “non-compliant” and blames the doctor for his death because he continued to treat him. This is like charging the doctor for a death when the doctor treated a patient with a cholesterol medicine who then has a heart attack and dies because he didn’t take his medicines regularly. Do we see that happening? Of course not. So then why is it happening with treating pain? Only because they can. They’ve set up the false narrative, the propaganda over the last 20 years, and they get away with creating a crime where there is none.
And to add insult to injury, they are also charging Dr. Deshmukh with Medicare fraud, saying the prescriptions he wrote for the patient were “unnecessary”, and therefore fraudulent. That is so they can go back and claim all the Medicare payments for the last 5 years. It’s a real racket (on the government’s part).
We have to end these attacks on good, caring doctors. The only way to do that is to repeal the Controlled Substance Act. And the only way to get that done is to show people that the fake opiaphobia was a government DOJ plan for money and salaries. Drugs don’t cause addiction. And as long as we don’t accept that and learn the real cause (which I teach), more people will die from lack of treatment or being forced to the street for self-treatment. Dr. Deshmukh was acquitted May, 2023 by the judge in a bench trial. Congratulations, Dr. Deshmukh. I hope you can get on with your life now, and will join the fight to stop these attacks on others.

Can’t wait for him to return to work. The first thing the new MD I B was given stopped Dr Deshmukh’s treatment of me & it nearly killed me. Dr Deshmukh saved my life 3 times but an inexperienced new grad stopped all my treatments, I lost 50s lbs & nearly died. Deshmukh was the best internist I ever had. He was scapegoated
I had him as my doctor for over 20 years. He has been the best doctor that I have ever ever had. I’ve had a few in between here and there because of when he went away but didn’t care for none of them. Now that he is back I’m going to try and get him back as my doctor. He really cares about his patients. He listens to them. He takes the time to answer their questions. He is super fantastic. He had done nothing wrong. He isn’t capable of doing anything like that. He’s the best doctor I’ve ever had.
I was actually a patient of Dr Deshmuk. He treated me fairly and was completely different to what they are painting him as. I have a Crohn’s disease and a long complicated history with pain management. Due to that I had a dependency to pain medications at the time I was being treated by him as my primary dr. He not only was extremely against over prescribing me medications but was trying to help me find something that would work for my pain but not allow my issues to get worse. I ended up having to go to another doctor because at the time he actually became uncomfortable with how much pain medicine I was getting from other doctors and couldn’t get me to a place where he was comfortable continuing with the amount of pain management I still needed despite his efforts to get me down on lower doses. I found him to be extremely caring and did the right thing for me and also for himself. So when I saw these charges against him I just couldn’t believe it was the same doctor who I had that was so careful with these medicines.

A reasonable and prudent observer would find that the actions of the DEA and Boards of Pharmacy inspectors are being used as a cudgel to destroy the Black middle class and minimize the possibility of generational wealth.
A major reason for this conclusion is that the administrative process is used to force practitioners out of business regardless of the truth of the allegation.
In order for someone to break the law, I thought that there had to be a law in place??? Even the CDC itself stated these were just guidelines in regard to the 2016 Guideline Debacle! If these guidelines aren’t codified into actual law, how can they use them for prosecution and/or prosecution??? They are singling out a particular group of citizens which is not equal treatment under the law anyhow??
They are being charged by the Controlled Substance Act, not by the CDC guidelines. Chasing the CDC guideline rabbit will get you nowhere. We have to repeal the CSA. Using the guidelines in court is just adding to the juror’s propaganda taught to them by the government over the last 20 years:
1. Opioids cause addiction
2. Anyone taking an opioid is an addict (including pain patients)
3. Doctors provide opioids to addicts (patients)
4. Doctors are drug pushers and criminals.
The government has worked this cookie cutter approach since 2000, long before the CDC guidelines. And if people don’t start working on what will work, they won’t see opioids in the future at all.
This is typical for the abuse from the government. They keep reinventing the wheel. I’ve had many a patient throughout my career, pass away from non-opioid related substances. That is just a fact. Humans are very weak and fragile. It does not take much to die. As soon as somebody dies when it is opiate related, we have to question. Whether this was the case here–unnecessary prescribing, prescribing a dose too high (which is never the case since nobody really has guidelines stating they can only prescribe so much, only recommendations). Then they start bringing in that you abuse Medicare because you prescribe the drug and the patient did not need it. I’m sure the record shows this patient suffered from chronic pain. You step outside yourself, and you look at all this b******* and imagine if you had no medical training and you read this. You would believe it which is why we’re being persecuted. The government knows what the people want to hear in order to persecute us. This is a huge problem. Not knowing much about this case, I’m going to ponder a guess. I would say the patient had a chronic legitimate medical condition, that led to immobility that probably let the other health problems and made the patient fragile. I’m going to take a wild guess instead of the patient probably did not die directly from opiates but they’re going to make it seem like he did. And of course, there was no guilt here of fraudulent prescribing if there was documentation of the patient having symptoms. We have to put our heads together and figure out how we’re going to combat this government abuse, this government overreach. I’m not certain that reversing or repealing the CDC guidelines alone is going to do it. The only way out I see is lawsuit, lawsuit, lawsuit, lawsuit. Class action lawsuits. We need to go to court with our own specialist our own experts raising our own arguments.
I totally agree. Once the marijuana legalization occurs federally, and all the innocent incarcerated users are freed and compensated, those of us incarcerated through the CSA and patients prevented treatment need to sue.
