Byung Kang, MD a 77 y/o family practitioner in Little Falls, NJ was indicted March, 2017 under the state’s strict liability law, which is meant to hold drug dealers accountable for overdose deaths, as well as drug distribution charges. This law was written in 1987, proof that it was directed at drug dealers, because doctors were not being illegally attacked under Title 21 at that time. Doctors are not drug dealers. This is one of the illegal acts of the US government, and now states are following suit–to charge doctors as “drug dealers”, through misuse of the law that actually exempts doctors from just such charges. In the overdose case, Dr. Kang is accused of issuing oxycodone prescriptions to a 26-year-old who was found dead in December 2014. But doctors should not be held liable for patients who misuse their prescription. That’s like holding Ford accountable for vehicular manslaughter when a drunk driver causes a fatal wreck.

Let’s look at how the media and the government work together to incarcerate innocent physicians. Media reported the government position that Dr. Kang sold 90-pill bottles of oxycodone to patients with “no medical need” for $150 to $200 apiece. That is supposed to give the jury pool a preconceived idea that he was “dealing”. But here is the reality. Oxycodone can be correctly dosed up to 6 times per day. So 90 pills for some patients would only be a 15 day supply. Second, government agents don’t have a medical degree, so they can’t determine “medical need”. But they always throw that statement out to the press anyway. The fact is that an undercover agent saw the doctor, was evaluated and treated, but then complains that they got opioids for their medical condition. The fact that they were “patients” proves that they were seen in the doctor’s office, evaluated, and his medical opinion for treatment was oxycodone. That is all that is necessary to determine medical need, not some US Attorney who makes six figure bonuses for the size of the sentences these innocent physicians get.

They then try to make it look like he was simply selling prescriptions by saying “for $150 to $200 apiece”. Those prices are standard office visit prices, maybe even lower than normal for this area of New Jersey. It is truly amazing how the DOJ can word completely normal behavior and make it sound criminal. But they are becoming experts at doing just that–”creating crime where there is no crime”–simply through stringing words together. To achieve the indictment, the “authorities” claimed that the doctor’s “own records allegedly revealed that he knew many of those patients were addicted to oxycodone or were reselling the pills.” The DEA agent Steven Tomaziefski in my case told the same lie to the Grand Jury, which is the only reason I was indicted. My guess is that the government agents lied in this case too.

And so we get to the REAL meat of the attack–”the state seized more than $1.4 million from the Kangs. And to make sure that the government forfeits it all, Dr. Kang’s wife, Soo Kang, who worked as a receptionist for the practice, also faces charges of conspiracy, money laundering and tax fraud with the doctor.

According to Dr. Kang’s lawyer, Stephen Turano, he intends to plead not guilty. So, New Jerseyites, it is really important for you to get the word out to everyone in the state to inform the population about the evil being done here to a legitimate physician and his family. I would be happy to come anywhere in the state and provide seminars or talks on the issues at hand, for costs alone.

Addendum

Sept, 2021 and there is nothing new on this case in the news.  His license was temporarily suspended in March, 2017. It still shows suspended on the Board of Medicine registry. And after seizing over $1.4 million that they can keep due to DOJ abuse, they have what they were after. So maybe they will just end the process with him not being in practice and at 81 years old.

Anyone in communication with him, please tell him to work on forgiveness and when he is ready, join us in the effort to restore humanity to the nation.

Addendum from the author:

I have failed in my mission to end these attacks on doctors and pain patients. Through John Bevere’s book The Bait of Satan, I have figured out why—my lack of forgiveness to those who attacked me. As in Mark 11: 24-26:

“Therefore I say to you, whatever things you ask when you pray, believe that you receive them, and you will have them. And whenever you stand praying, if you have anything against anyone, forgive him, that your Father in heaven may also forgive you your trespasses. But if you do not forgive, neither will your Father in heaven forgive your trespasses.”

And when you do not do the will of the Father, you are estranged from him and he will ignore you.  So we all must forgive the agents who attacked us in order for things to be made right through any of our works.

Jesus said

“Greater love has no one than this, than to lay down one’s life for his friends.”

But we cannot lay down our lives for God unless we know Him well enough to trust Him. We must have the assurance that He would never do anything to harm us. He always looks out for what He knows is in our best interest. As a nation, those of us suffering from these attacks must understand that we are serving as God’s messengers of love.  We must forgive those who persecute us and love them instead, following God’s will for us. Then and only then will we see fruits from our labor.

So I hope that everyone who has suffered from what happened to the doctor can trust the Lord, forgive those who have hurt you, and help bring this country back to the God-fearing country that our forefathers founded. Then, and only then, can you be a part of the effort to stop these attacks. I look forward to that day.
