Qing McGaha, MD, 55, is the next minority physician to be targeted by the rogue US Department of Justice. Dr. Qing McGaha is a PM&R physician in Clearwater, FL. She received her medical degree from Tianjin Medical University in China, but then came to America for her internship and residency at the University of Arkansas for Medical Sciences College of Medicine. She has worked in the US now for 20 years, and the government is after every dollar she made while working here. Standard government protocol—bring in foreign doctors for slave labor in hospitals, then charge them with this crime using the Controlled Substance Act illegitimately.

Qing McGaha, MD was indicted with conspiracy to commit unlawful distribution of controlled substances and unlawful distribution of controlled substances “for no legitimate medical purpose and outside the usual course of professional practice”. This phrase is modified out of the Controlled Substance Act. The actual phrase, as written and understood, is supposed to protect doctors from prosecution using this law, designed to attack drug cartels. But since 1998, the DOJ has created crime where it doesn’t exist, simply because they can. In this attack on Dr. McGaha, the goal of the DOJ, in addiction to just a 2-year job security as they create a case against Dr. McGaha, is to forfeit almost $1 million dollars of income for doing her job.

All doctors need to understand this—you are working for NOTHING!  The government knows you are low hanging fruit, that you will do nothing to protect yourself, or work with your fellow doctors to end these outrageous, egregious attacks.  They will simply go after you one at a time for their own greedy desires. If they can’t get you on controlled substance charges, they will get you for insurance fraud.

The method of attack on Dr. McGaha, as well as others across the country was for fake patients—agents of the DEA—to go to the office with a complaint of pain when they had no pain. But doctors must trust their patients to tell the truth.  These DEA agent fakes lie to the doctor. Then on the witness stand at trial, they claim they didn’t have pain, and the prescriptions given to them were then illegitimate. This should be entrapment and illegal, but the government has protected itself from these charges.

As written in their indictment, the DOJ admits that

“Over a 20-month period, undercover agents with the Drug Enforcement Administration conducted numerous appointments with McGaha and at each appointment received an opioid controlled substance…”

So Dr. McGaha treated these fakes as legitimate patients, and her prescribing was to treat whatever condition they presented with.  This is standard protocol with the cookie-cutter prosecutorial protocol used against any doctor they target.

And with the propaganda they have put in every American head—that opioids cause addiction—and the lawbreaking they do with perjury and falsifying records, they have a 98% success rate of conviction. The real law-breakers are USA Roger Handberg and AUSA Greg Pizzo.
