On October 7, 2014, life as he knew it ended. Daniel Cham, MD, MS, a 47 year-old hard-working, dedicated, seasoned physician, was indicted with charges of drug trafficking, money laundering, fraud and making false statements to federal authorities. These charges were based on prescribing controlled drugs to patients.

At the advice of his attorney, Dr. Cham pleaded guilty in April, 2016, to one count of distribution of oxycodone and one count of money laundering. The problem is that he was forced to accept a plea that was not true. Believe it or not, this happens to innocent people 97% of the time.

So how can this happen in a country that supposedly, by its history, believes “It is better a hundred guilty persons should go free than one innocent person be convicted.” Per the Cato Institute, this quote is attributed to Benjamin Franklin. It reflects a principle known as Blackstone’s Ratio, which emphasizes the importance of avoiding wrongful convictions, even if it means some guilty individuals go unpunished. There is even a statue of William Blackstone located at Constitution Ave & 3^rd St. NW in Washington D.C, one mile from Congress. The core sentiment behind this statement is that the potential harm of convicting an innocent person is considered more severe than the injustice of allowing a guilty person to go free. And yet, since the Enron fiasco in 2000, our government justice system is based on conviction at all cost, even if it means perjury, lies, and actual law breaking.

Now, our government no longer worships God, but its own idols: money, prestige, position, and power.

The fake charges the government levied against Dr. Cham included:

1. Postdating prescriptions
2. Prescribing the “Holy Trinity” which is the combination of an opioid, Xanax, and Soma together.
3. Accepting payment for visits in cash.
4. An undercover operative made accusations against Dr. Cham in how he conducted his visit, supposedly exhibiting a “red flag” of alcohol use.
5. Issuing prescriptions to a person who supposedly used false identities.

Now, none of these charges are actually illegal activities when they can all be negated with REAL medical decision-making with legitimate patient care. The Controlled Substance Act was not designed to be woven through misinterpretation to attack legitimate, trained physicians. This action by the DOJ is abuse of power and weaponization of the Justice Department.

The government then claims it was evidence of his illegal activity that he had several bank accounts that he used to “launder the proceeds of his illegal prescriptions”. Since when is it illegal for someone with several businesses to have multiple bank accounts?  Only when the government sets you up with propaganda as a “drug pusher”.

The propaganda-inducing quotes to the press by government officials who attacked him include:

Anthony D. Williams, DEA Special Agent Division:

“Daniel Cham’s arrest sends a clear message to doctors… – the DEA will shut down your operation and put you behind bars,”

Acting United States Attorney Stephanie Yonekura:

“The problem of pharmaceuticals being diverted to the black market continues to grow, which feeds drug addiction and leads to additional criminal acts by addicts,” “Doctors who prescribe controlled substances without a legitimate medical purpose are simply fueling a black market of narcotics. These doctors are the same as street dealers.”

Assistant United States Attorney Ben Barron:

“Dr. Cham was not practicing legitimate medicine. Dr. Cham was, in the eyes of the law, a drug pusher,”

And this is how the government has changed our justice system to the point that a doctor now has to prove his innocence against the propaganda the government has planted in the minds of every American that:

1. Opioids are addictive
2. Anyone on an opioid is an addict.
3. Doctors provide opioids to addicts.
4. Doctors are therefore drug pushers.

None of those statements are true. But it takes 50 years to offset propaganda, and we are only 20 years into the current anti-opioid propaganda phase.

One of the propagandas used against doctors, including Dr. Cham, is the prescribing of opioids, Xanax, and Soma together.  This combination has been prescribed for decades without problems. It was only after the government decided to target it to convict doctors that it became problematic. Again, in order to get the maximum penalty, the government stated in their sentencing report that “The combination of these drugs is particularly dangerous, and is associated with the majority of overdose deaths.” That, in fact, is a lie.

At the time of sentencing, the prosecutors wrote to the court that Dr. Cham “stands before the court for selling prescriptions for massive amounts of oxycodone to persons he well knew were drug dealers and addicts, in exchange for hundreds of thousands of dollars in cash.

Everyone needs to understand that this kind of prosecution can happen to any doctor the government wants to target that is prescribing controlled substances. The REAL criminals in this case are: DEA Special Agents Anthony D. Williams and David J. Downing, FBI Assistant Director Paul Delacourt, IRS Special Agent R. Damon Rowe, Acting United States Attorney Stephanie Yonekura, Assistant United States Attorney Ben Barron, United States Attorney Eileen M. Decker, United States Attorney Nicola T. Hanna, United States District Judge Dean D. Pregerson, United States District Judge Andrew J. Guilford, the Los Angeles County Sheriff’s Department’s Health Authority Law Enforcement Task Force, the Federal Bureau of Investigation, the California Medical Board, and the Los Angeles Police Department. All of these organizations get a part of the money confiscated for the conviction of any doctor they help to convict. So it behooves them to do whatever is necessary to get a conviction, even to the point of lying or breaking the law themselves.

Dr. Cham was sentenced March, 2018 to 13 years, 4 months. Actual cartel drug dealers or murderers often don’t get that much time in prison. But doctors are easy prisoners and they don’t cause problems. Since part of the Federal Justice System is to support the Federal Bureau of Prisons, giving doctors hefty sentences fills the beds with easy prisoners.
