Thomas M. Keller, MD, 72, is a neurosurgeon, pain management specialist, and addiction medicine specialist with suboxone treatment in Santa Rosa, CA. With 46 years of experience in his specialty, he is now a target of the DOJ and is being batted back and forth by the US DOJ and the California AG. The method in this double teaming is usually to force the victim into a plea. “Throw enough charges at you from enough directions and you will cave” is the thinking process of the rogue DOJ.

Back in September, 2018, Dr. Keller was indicted federally for unlawfully prescribing fentanyl and oxycodone “outside the scope of his professional practice and without a legitimate medical need” and 2 counts of billing health care fraud, one to Anthem Blue Cross of California and one to Medi-Cal, according to USA Alex G. Tse,

The charges were based on the following prescriptions:

1. June 2017 for oxycodone
2. March, 2018, for Tramadol
3. July, 2018 for fentanyl

Since forfeiture of a doctor’s assets is spread around the investigating agencies, those mentioned to get financial support are the DEA, FBI, DHHS-OIG, and California’s Bureau of Medi-Cal Fraud and Elder Abuse (BMFEA).

Obviously Dr. Keller chose to fight the charges. So now the state of California has jumped in to twist his arm with murder charges. California Attorney General Xavier Becerra had Dr. Keller arrested and placed in jail this week for the deaths of five patients. Three of those patients are documented suicides, and one was an unintentional overdose with methadone not prescribed by Dr. Keller. But that doesn’t stop the government from levying ridiculous charges to get the doctor to eventually cop a plea. Wear them down, throw on more charges, and the government can confiscate all the doctor’s assets without the cost of a trial. Simple, isn’t it? What a shame our country has stooped to illegal persecution of innocent citizens for the monetary advancement of rogue government agencies and the politicians running them.

California Attorney General Xavier Becerra states in his press release:

“The California Department of Justice will prosecute fairly all those who are alleged to have abused our healthcare system and over-prescribe drugs at the expense of their patients.”

In the criminal complaint, each count states that Dr. Keller “killed a human being” “ with implied malice aforethought in violation of Penal Code section 187 (a).

Malice aforethought is the deliberate intent to cause death or great bodily harm to another person before a person commits the crime. Malice aforethought is comprised of any one of the following three elements:

1. an intent to kill;
2. an intent to inflict grievous bodily injury; or
3. an intent to act in a manner that creates a plain and strong likelihood that death or grievous harm will follow.

Of these three prongs of malice, the first two prongs require a specific intent on the part of the defendant, measured subjectively, while the third prong only requires a general intent, measured both subjectively and objectively. Accordingly, malice aforethought may exist without an actual intent to kill or do grievous bodily harm, if there is proof of the “third prong” of malice. This simply means that the perpetrator knew of circumstances that a reasonably prudent person would have known created a plain and strong likelihood of death or grievous bodily harm resulting from the perpetrator’s act.

The government has laid the propaganda out through the media that they will now use against Dr. Keller and other doctors in California who have been identified through the government searches of the PDMP and CURES.

They will be hanging their cross on the “third prong” of malice through making comments like:

This is the first time that a California attorney general has filed murder charges against a doctor for overprescribing opioids, but you can bet it won’t be the last, especially if Dr. Keller cops a plea, or if he goes to trial and has poor representation that doesn’t fight the propaganda with the truth.

Everyone throughout the country needs to understand that a doctor’s treatment of pain does not constitute “malice aforethought”. We MUST stop these attacks on doctors for money by the rogue government, using propaganda to brainwash America.

Addendum:

In March, 2020, Dr. Keller was acquitted at trial on 4 of the 9 counts against him. However, the remaining 5 were undecided.  The government has money and jobs to support, so they retried him and in November, 2022, in spite of the Ruan/Kahn SCOTUS decision, he was convicted of distribution to patients, totally against the intent of the CSA.  So at the age of 75, he was sentenced to 30 months in prison.

Addendum:

I have failed in my mission to end these attacks on doctors and pain patients. Through John Bevere’s book The Bait of Satan, I have figured out why—my lack of forgiveness to those who attacked me. As in Mark 11: 24-26:

Therefore I say to you, whatever things you ask when you pray, believe that you receive them, and you will have them. And whenever you stand praying, if you have anything against anyone, forgive him, that your Father in heaven may also forgive you your trespasses. But if you do not forgive, neither will your Father in heaven forgive your trespasses.

And when you do not do the will of the Father, you are estranged from him and he will ignore you.  So we all must forgive the agents who attacked us in order for things to be made right through any of our works.

Jesus said

“Greater love has no one than this, than to lay down one’s life for his friends.”

But we cannot lay down our lives for God unless we know Him well enough to trust Him. We must have the assurance that He would never do anything to harm us. He always looks out for what He knows is in our best interest. As a nation, those of us suffering from these attacks must understand that we are serving as God’s messengers of love.  We must forgive those who persecute us and love them instead, following God’s will for us. Then and only then will we see fruits from our labor.

So I hope that everyone who has suffered from what happened to Dr. Keller can trust the Lord, forgive those who have hurt you, and help bring this country back to the God-fearing country that our forefathers founded. Then, and only then, can you be a part of the effort to stop these attacks. I look forward to that day.
