Shiva Akula, MD wrote the following commentary on courtroom proceedings from prison.

Oprah Winfrey asked Carolyn Burke “What is the definition of God?” Carolyn said “God is law so judge is a Divine being”.

 

 

Is it godly for a judge to allow an inadmissible hearsay expert report despite the Government admitting it is a mistake?

Is it godly to deny the defense’s constitutional right to present an expert witness leaving only the government nurse expert witness to testify on Medicare billing matters?

Is it godly for a judge to make money out of the misery of little guys, denying them due process favoring corporates litigants whose stock the judge and his family owns?

Is it godly when the judge sneaks into the jury room for a juror to tell the judge: “Do not come in there,” in open court?

Is it godly to cover a prosecutor’s ex parte communication with a judge to influence her judgement as if it was not done in bad faith?

Is it godly when the judge asks questions to supplement a prosecutor on what the prosecutor should have asked that would support the Government’s argument?

Is it godly when you talk of unanimous decision based on evidence and not the arguments while asking them if they want pizza?

I sense a hidden message in my conviction.

There is a law of reciprocity for a jury’s obligation to pay back in conviction for various goodies they got at meals which the judge brags about in open court.

Is it godly for the judge to brag about another defendant in a totally different case “I ordered a 70 year old doctor to 20 years in prison while statutory max was 10 years!”

Is it godly when a judge excludes cases where government witnesses were ordered codefendants in civil cases that dealt not only with Medicare billing but Canon payroll indictment deals with Medicare Billing?

Is it godly when the judge disallows the person who billed Medicare who was willing to testify, while a prosecutor lies to another judge at arraignment that the biller fled the country while customs records show he was still in the US?

Is it godly when the prosecutor raises an objection on me talking about AIDS in my infectious diseases practice? The judge threatened to discipline my counsel for disobeying his order not to talk about AIDS. Actually that was not even his order. His order excluded Covid and the Akula family foundation. My counsel was afraid to say the judge lied and was biased toward the prosecutor.

Is it godly to order denial of payroll to my only employee witness that told the truth in the testimony?

Is it godly when you declare time out when defense gains momentum in their questioning? The judge is like a referee. Referees don’t call time out without one of the two teams asking for one. The judge did this multiple times.

It is my dream to make hospice available to every terminally ill patient, especially if they don’t have insurance. This was very special to me, being a witness to a relative who died of cancer without any financial resources at home. That’s why I said one call, that’s all, for patients that are duly qualified for hospice by doctors, not nurses or social workers who are not qualified but want to act like a doctor to be able to qualify patients for hospice.

I dreamed that no one should die suffering because of lack of funding for their pain management. They misled my appeals to say that I accepted every one whether they qualified or not to boost my census.

An inpatient hospice patient in the indictment was sent after having failed to manage her symptoms at home. Two other patients were also suffering. Medicare regulations cover both acute and chronic symptoms if they are not manageable in alternative setting.

The government misled the appeals judge saying that I needed to approve any discharge. There were two patients out of six in the indictment who were discharged. Nobody brought these discharges to my attention before they were sent home. One died in 10 days and another within two months. This was the reason we were cited for premature discharge which was brought to the medical director’s attention. These two patients that Government Nurse Expert said would not qualify for hospice actually died in less than the six months required for hospice criteria.

The government misled the jury with an email purporting to tell the team to get my approval for any discharge. One of the discharged indictment patients was an 87 year old grandma who was caring for several grandchildren—children who would have been orphaned as their mother took them to a motel where she died with drug overdose. Camp Swan team evaluated the children for our Akula Foundation Children’s Bereavement Camp. The Government Nurse Expert testified that this grandma did not qualify for hospice even though she died at home in two months without it. The judge had ordered us not to mention Camp Swan or any Akula Foundation activities.  

Coming out of the chapel, after sweeping and mopping the footprints of sinners. I pondered as to what is the meaning of all my suffering. Suffering ceases to be suffering when it finds the meaning or the purpose in it. Victor Frankl said this in his book “Man’s search for a meaning”

My purpose is to expose this judicial corruption. Operation clean sweep where judges don’t use their spouses and family members to rule on the cases they benefit from with favorable rulings to enrich themselves.

Wall Street and New Orleans Advocate reported Judge Africk as the highest conflicted judge in Louisiana. I sent in multiple cases with potential conflict to firth circuit over a year ago with no response. If investigated, Judge Africk could be the highest conflicted judge in the country as he was doing this for over three decades. There were 130 judges in the report that ruled on over 600 cases.

My counsel Niles Illich declared me Paparelli (poor and indigent) denying the fight for my assets. One of them included a 3.75 Million dollar charitable irrevocable trust for community activities. One might say that I don’t have money now for clemency. My intention is to arouse American conscience or perhaps global conscience to look at this problem so that the little guys get justice.

I have dealt with thousands of people dying in decades of my dealing with hospice. This process of false criminal conviction brought a death to my Ego and to my emotional being so my actual death would be as easy as Goodbye, love you and see you in next life.

Michael Singer, in Untethered Soul, observes that death is a great teacher. Its only after death we know we are not going to carry riches, not even our body. That’s the reason why I did not want to take my organs to heaven but let them be used by fellow Americans who are dying for lack of donors while waiting in the thousands for various transplants. This did not matter to my judge, as instead of mitigating factors he doubled up my sentence for alleged lack of remorse. He was retaliating for bringing up the highest conflicted financial state.

Jesus said: you can gain all riches in this world but lose your soul. I have lost my family, house, car, business, investments, insurances but spiritually I feel very strong. I feel the full expression of Christ, conscious with Peace, Love, Joy, Happiness, Kindness and Compassion.

Like great Indian saint Shankaracharya said on the question of Who am I?

I am the human form of pure soul with infinite bliss.

My reply to Dr. Akula’s commentary.

Our country has separated itself from God and God’s law.  We are now worshiping money and power, claiming we are more powerful than God.  This is going to be our downfall if we don’t change our ways. But that is up to the people.  Their votes year after year putting the same people in Congress who have led us to this impasse.  Putting Donald Trump in the driver’s seat for this country who is driving us to oblivion. We must return to God if we want to see change.
